Terms and Conditions - Service Agreement and Late Payments Policy


Eco Skips Whitsundays


Effective Date: 1st May 2025

1. Definitions

1.1 "Company" refers to Eco Skips Whitsundays.
1.2 "Customer" refers to any individual, business, or entity engaging the Company’s services.
1.3 "Services" refers to the supply of skip bin hire and waste disposal services provided by the Company.
1.4 "Agreement" refers to the contract formed between the Company and the Customer upon booking services.

2. Payment Terms

2.1 Payment Due Date:

For Domestic and Non-Trade Account Customers: Payment is due immediately upon delivery of the invoice (Cash on Delivery - COD).

For Trade and Credit Account Customers: All invoices issued by the Company are due for payment within 7 days from the invoice date unless otherwise agreed in writing.

2.2 Payment Methods: Payments may be made via bank transfer, credit card, or other approved payment methods as specified on the invoice.

3. Overdue Payments & Late Fees

3.1 If payment is not received by the due date, the Customer will be considered in default and subject to the following late fees:

  1. A flat late payment fee will be applied to each overdue invoice remaining unpaid after the due date.

  2. $25 flat rate for Invoices under $1000

  3. $50 flat rate for invoices under $2000

  4. $100 flat rate for invoices over $2001

Additional collection costs, legal fees, or debt recovery charges may be applied if the debt remains unpaid.

3.2 The Customer agrees that failure to pay within 7 days of the due date may result in suspension of services, refusal of future bookings, or legal action.

4. Liability & Indemnity

4.1 The Company shall not be held liable for any damages, loss, or delays caused by circumstances beyond its control, including but not limited to weather events, road closures, or third-party actions.
4.2 The Customer is responsible for ensuring that all waste materials disposed of comply with legal and environmental regulations.

 

5. Ownership and Return of Skip Bins

 5.1 All skip bins provided by Eco Skips Whitsundays remain the property of Eco Skips Whitsundays at all times. 

 5.2 The customer agrees to ensure the safe use of the skip bin and its safe return upon request

5.3 The skip bin must be made ready for retrieval and returned within a reasonable timeframe, and failure to do so may result in additional charges.

5.4 In the unlikely event that a skip bin goes missing, is damaged, or cannot be located upon request, the customer will be liable for the full replacement cost of the skip bin. This charge will be added to the final invoice.

6. Governing Law

6.1 These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes arising from this Agreement shall be handled in the appropriate jurisdiction within Queensland.

By engaging Eco Skips Whitsundays, the Customer acknowledges and agrees to these Terms and Conditions.
